nbc news Supporters of convicted murderer, Scott Peterson, are on a crusade to get his conviction overturned.


According to 10 News, a petition over 200 pages is a writ of habeas corpus that's been filed with the Supreme Court of the State of California.

Peterson was convicted in 2005 of first-degree murder for the death of his wife, Laci Peterson, and of second-degree murder of their unborn child.

Laci disappeared on Christmas Eve of 2002 from their Modesto home and was found dead on the shoreline of San Francisco Bay in 2003. Scott had boated there on the day of her disappearance. He was arrested in April 2003 and convicted of the murders in March 2005. He was sentenced to death by lethal injection and now lives life on death row in California.

A website regarding Scott Peterson's appeal was created by his family. In the long petition are 19 highlights claiming there's now enough evidence in Peterson's favor that a court should overturn his conviction.

Peterson's sister-in-law, Janey Peterson, said it hasn't been an easy road in seeing this petition through, but she says Scott got an unfair shake in the justice system.

”It’s been difficult and we’re on the long path to justice,” Janey Peterson said. “The basis of a habius petition is new evidence that was not presented in the courtroom.”

There are several points raised in the petitions, such as claims a juror lied on her application and shouldn't have ever been in the courtroom to begin with.

“One of the jurors evidently lied on her jury application. She said she’s never been involved in a lawsuit. She’d never testified as a witness. Both those things are not true,” Janey Peterson said.

Additionally, there is supposed evidence that Laci Peterson was seen out walking her dog, according to several neighbors. This was all before Scott left for the day. Janey Peterson said this tells her that not only does this help prove her brother-in-law is innocent, but that he didn't get a fair trial.

Another highlight in the habius petition states that Scott lacked effective counsel. Janey said there were “things that Mark Geragos could have done better.”

Will the Scott Peterson petition be something that the California Supreme Court will examine?
